禁售VS強(qiáng)制使用:iPad在華遭遇冰火兩重天
????唯冠科技(深圳)有限公司(Proview Technology(Shenzhen))不僅令蘋果公司頭疼,它對中國政府來說同樣是個(gè)大麻煩。 ????大家可能還記得,瀕臨破產(chǎn)的電子產(chǎn)品制造商唯冠公司成功地通過中國南方省份廣東的一家地方法院要求禁售蘋果產(chǎn)品iPad。唯冠公司聲稱,盡管蘋果公司于2009年從唯冠國際控股公司(Proview International Holdings)收購了所謂的全球范圍內(nèi)的iPad商標(biāo)權(quán),但由于后者并不能代表深圳唯冠,所以此交易在中國大陸無效。 ????據(jù)我所知,不僅僅是廣東省政府,中國最高權(quán)力機(jī)構(gòu)全國人民代表大會(the National People's Congress)也并未對這一省級法院的裁決做出評論。蘋果公司依然在大批量生產(chǎn)iPad,其中很多恰恰是在廣東省最大城市之一深圳生產(chǎn)的。三月底,中國質(zhì)量認(rèn)證中心(China's Quality Certification Center)為新iPad授予了強(qiáng)制認(rèn)證(compulsory certification)。雖然存在地方性的禁售令,但該強(qiáng)制認(rèn)證為蘋果公司產(chǎn)品在中國大陸的銷售掃清了道路。 ????海南省和廣東省之間就隔著一條狹窄的海峽。目前海南省政府的舉動讓事態(tài)進(jìn)一步復(fù)雜化。海南省政府要求位于三亞的海鮮餐廳使用iPad點(diǎn)餐。三亞是海南的一個(gè)沿海度假城市,每年都能吸引幾十萬游客。今年春節(jié)期間三亞出現(xiàn)的宰客事件使得該地區(qū)備受民眾抨擊。當(dāng)?shù)卣诩酵ㄟ^采用更易監(jiān)控的iPad點(diǎn)餐來解決當(dāng)?shù)芈糜螛I(yè)面臨的困境。 ????在瓊州海峽這邊禁用iPad,同時(shí)卻又在這個(gè)海峽的另一邊強(qiáng)制要求使用iPad。中國怎樣才能自圓其說? ????恐怕不能。蘋果公司對禁售令提起上訴的裁決期限是五月底,然而廣東省高級人民法院上周表示,如果雙方還在進(jìn)行和解談判,法院不會宣判。 ????但據(jù)報(bào)道,談判雙方的分歧很大。而蘋果公司作為中國最大規(guī)模的外國制造商之一并未表現(xiàn)出任何和解的意向。 ????因此,現(xiàn)在唯冠公司成了所有人的眼中釘。 ????譯者:李玫曉/汪皓 |
????You have to wonder whether Proview Technology (Shenzhen) is as big a thorn in the Chinese government's side as it is in Apple's (AAPL). ????As you may recall, the nearly-bankrupt electronics manufacturer succeeded in getting a court in the southern Chinese province of Guangdong to ban the sale of iPads on the strength of Proview's claim that although Apple in 2009 purchased what it thought were the worldwide rights to the iPad trademark from Proview International Holdings, the deal was invalid on mainland China because Proview (Shenzhen) was not represented. ????As far as I know, the National People's Congress -- which governs all of China, not just Guangdong province -- has not commented on the provincial court's ruling. But Apple continues to manufacturer iPads by the millions, many of them in Shenzhen, one of Guangdong's largest cities. And in late March China's Quality Certification Center granted the new iPad compulsory certification, clearing it for release on the mainland despite the local ban. ????Now the government of Hainan, an island province just across a narrow strait from Guangdong, has further complicated matters. It is requiring seafood restaurants in Sanya, a coastal resort city that draws tourists by the tens of thousands, to take food orders on iPads. The region was rocked by a price gouging scandal after the most recent Chinese New Year holiday, and the more-easily monitored iPads are part of the local government's solution to the problem. ????How can China ban iPads on one side of the Qiongzhou Strait and require their use on the other? ????It probably can't. Although a ruling on Apple's appeal of the original ban was due at the end of May, the Higher People's Court of Guangdong said last week that it won't issue one as long as the two sides are engaged in settlement talks. ????But the two sides are reported to be far apart, and Apple -- one of China's largest foreign manufacturers -- shows no inclination to settle. ????Which makes Proview a thorn in everybody's side. ????Below the fold: For readers haven't been to Hainan recently, I've added a 2005 photo of Sanya Bay (via Wikipedia). |
